Terms of Service
Michi (the "Application") is an app that calculates what a road trip in Japan will cost in expressway tolls and whether an expressway pass would save you money. It is owned and operated by Pegasus Coders LLC ("we", "us", or "our"). By downloading, installing or using the Application, you agree to these Terms of Service (the "Terms"). If you do not agree, do not download, install or use the Application.
- Tolls and pass verdicts are estimates to help you plan. What you actually pay is set by the expressway operators and your rental company. See Section 4.
- Never use the Application while driving. Plan before you set off, or when you are safely parked.
- Michi is free, with an optional one-time purchase, Michi Pro, billed and refunded by the app store. See Section 2.
1. Eligibility and license
- Age. You must be at least 13 years old to use the Application.
- License. We grant you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application for your personal, non-commercial use on devices you own or control. Your use is also subject to the terms of the store you got the Application from: the Apple Media Services Terms and Conditions, or the Google Play Terms of Service.
- Restrictions. You may not copy, modify, resell or redistribute the Application, or reverse-engineer it or extract its data except where the law allows it or a license in Section 7 grants it.
2. Price and Michi Pro
- Free to use. The Application is free to download and use. Every feature is available in the free version, which keeps two trips at a time and is supported by advertising.
- Michi Pro. An optional one-time, non-consumable in-app purchase that removes the ads and lets you keep as many trips as you like. It is not a subscription: you pay once, at the price shown in the store, and there is nothing to renew or cancel. Payment is charged to your App Store or Google Play account when you confirm the purchase.
- Restoring and sharing. Michi Pro is tied to the store account you bought it with. On iPhone and iPad you can restore it with "Restore Purchase" and use Apple Family Sharing where eligible. On Android, ownership is restored through Google Play on devices using the same Google account; Pro in-app purchases are not shared through Google Play Family Library. An App Store purchase does not unlock Pro on Android, and a Google Play purchase does not unlock Pro on iPhone or iPad. Separate purchases are required to use Pro across the two stores.
- Billing and refunds are handled by Apple or Google Play under their own terms, not by us. Request a refund from the store you bought Michi Pro from.
- Changes. We may change what the free version or Michi Pro includes, or the price of Michi Pro for future purchases. If you have already bought Michi Pro, we will not take away its removal of ads or its unlimited trips while we keep offering the Application.
3. Your trips
There is no Michi account or server-side trip archive. Saved trips are stored on your device; search and routing use selected places as described in our Privacy Policy. We cannot recover or restore your saved trips for you. Device cloud backups, computer backups or device transfers may include app data, depending on your platform and settings. Uninstalling removes local app data, but existing backups may restore it when you reinstall or change devices. Managing backups and protecting your trip data are your responsibility; deleting local data does not necessarily erase backups or data already held by service providers.
4. Tolls, passes and the verdict are estimates
For planning only. The tolls, discounts, pass prices, savings and recommendations the Application shows are estimates, and may differ from what you actually pay. Check anything you rely on against the official sources before you book or buy.
- Tolls. Tolls are calculated from routes suggested by Apple Maps and from tariffs and discount rules published by the expressway operators. What you are actually charged depends on the road you really drive, the entrances and exits you use, the time you pass the toll gates, your vehicle's classification, how you pay, and the operators' rules in effect that day. Operators change their tolls, discounts and excluded dates, sometimes at short notice, and the Application's data may not yet include a change.
- Passes. Expressway passes are sold by the expressway operators through participating rental car companies, under their own terms, which set who can buy a pass, its price, the roads and dates it covers, and its conditions. Whether you can buy a pass, and what it costs, is for them to decide. The Application's recommendation is a comparison of estimates, not an offer, a guarantee or advice.
- Your decision. You are responsible for deciding whether to buy a pass, and for the tolls and charges you incur. We are not responsible for any cost, charge or loss that results from relying on the Application's figures or recommendations.
- Not affiliated. We are not affiliated with, endorsed by, or acting for any expressway operator, including the NEXCO companies, or any rental car company. Pass names, road names and operator names belong to their owners and are used only to describe what the Application covers.
5. Safe use and driver responsibility
- Not while driving. You agree to use the Application only while your vehicle is stationary and safely parked in a legal place. The driver must never interact with the Application while the vehicle is moving.
- Not a navigation system. The Application is a planning tool. Routes are shown to calculate costs, not to guide you. Follow road signs, traffic laws and the instructions of the authorities, which always take precedence.
6. Third-party services
The Application relies on Apple Maps for search, routes and map displays on both platforms; on Android, our Cloudflare-hosted service processes search and route requests before forwarding them to Apple. Other services include Google AdMob (advertising), Google Firebase (usage statistics, crash reports and toll-data update checks), Apple In-App Purchase and Google Play Billing (Michi Pro), and Cloudflare hosting for toll-data downloads. The Application also links to expressway operators' websites. Third-party services are governed by their own terms and privacy policies. We do not control, and are not responsible for, their availability, accuracy or practices.
7. Intellectual property and data sources
The Application, including its name, logo, icon, artwork, design and code, is owned by us or our licensors and is protected by copyright, trademark and other laws. Nothing in these Terms grants you any right to our trademarks.
The Application's road data includes data from these sources, used under their licenses:
- OpenStreetMap. Map data © OpenStreetMap contributors, available under the Open Database License (ODbL). See openstreetmap.org/copyright. The road data the Application derives from it is available under the same license; contact us for a copy.
- National Land Numerical Information. 「国土数値情報(高速道路時系列データ)(国土交通省)」を加工して作成 (created by processing the Expressway Time-Series Data of the National Land Numerical Information, Ministry of Land, Infrastructure, Transport and Tourism of Japan).
- Toll tariffs are compiled from figures published by the expressway operators.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION'S TOLLS, PASS PRICES OR RECOMMENDATIONS ARE ACCURATE, COMPLETE OR CURRENT, OR THAT THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEGASUS CODERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR MONEY, INCLUDING TOLLS, PASS PRICES, RENTAL CHARGES, FINES OR OTHER COSTS YOU INCUR, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. WE ARE NOT LIABLE FOR PERSONAL INJURY OR PROPERTY DAMAGE, INCLUDING VEHICLE ACCIDENTS, ARISING FROM USE OF THE APPLICATION IN BREACH OF SECTION 5.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR MICHI PRO AND FIFTY US DOLLARS (US$50).
10. Your rights as a consumer
Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of the country where you live, including any liability that cannot lawfully be excluded or limited. Where such laws apply, the disclaimers and limits in Sections 8 and 9 apply only to the extent those laws allow.
11. App store terms (Apple and Google)
These Terms are between you and us, not with the store you got the Application from. We, not the store, are responsible for the Application and its content, and for any maintenance and support.
- Apple. If you got the Application from the App Store, Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no other warranty obligation for the Application; if it fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. We, not Apple, are responsible for any claims relating to the Application, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes a third party's intellectual property. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Google. If you got the Application from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Application.
12. Ending these Terms
You can stop using the Application at any time by deleting it. We may stop offering or updating the Application, or end your license if you break these Terms. Sections 4 and 7 to 13 continue to apply after these Terms end.
13. Governing law
These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-law rules. Any legal action arising under these Terms will be brought exclusively in the courts located in California, except where the law of the country where you live gives you the right to bring it in your local courts.
14. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date at the top. If you keep using the Application after the new Terms are posted, they apply to you.
These Terms are also available in other languages. If a translation differs from this English version, the English version applies.
